Photography Services – Terms of Service

1. Services Provided

M&B Visuals provides professional photography services including but not limited to: portraits, events, couples, family business photography. All services and deliverables will be defined in individual agreements or booking confirmations.

2. Booking and Payment

  • A non-refundable deposit of 50% is required to confirm your booking.

  • The remaining balance must be paid no later than 30 days after the scheduled session or event.

  • Payments can be made via bank transfer or in cash.

  • Failure to pay the deposit on time may result in cancellation of the booking.

  • Clients will receive their selected final images without watermarks only after the full payment has been received and cleared. 

3. Cancellations and Rescheduling

  • Cancellations must be made at least 5 days in advance of the scheduled session, in writing. Cancellations within those 5 days will result in loss of the deposit.

  • Rescheduling is permitted with at least 5 days notice and subject to availability.

  • If the photographer must cancel due to illness, emergency, or other unforeseen circumstances, all payments (including the deposit) will be refunded or rescheduled at no extra cost.

4. Delivery of Photos

  • Edited digital images will be delivered within a certain time frame after of the session (depending on the amount of pictures) via a private online gallery.\

  • 1-100 photos: 1 week max / 100-500 photos: 2 weeks \ 500+ 3-4 weeks. 

  • The client will receive an agreed upon amount of edited images depending on the package selected. thereś always the option to buy extra photos, prices will be made clear in advance.

  • RAW (unedited) images are not provided unless agreed in writing.

5. Copyright and Usage Rights

  • The photographer retains full copyright over all images.

  • The client receives a non-exclusive, non-transferable license to use the images for personal use (e.g., prints, social media, personal websites).

  • Commercial or third-party use requires prior written permission and may incur licensing fees.

6. Model Release

By entering into this agreement, the client grants permission to use photographs featuring them (or others involved in the session) for promotional purposes, including but not limited to portfolio, website, social media, and advertising.
Clients may opt out of the model release by submitting a written request prior to the session.

7. Limitation of Liability

The photographer is not liable for:

  • Any loss of images due to technical malfunction, theft, or force majeure.

  • Missed moments caused by late arrivals, environmental conditions, or uncooperative subjects.
    Every effort will be made to provide high-quality services and deliverables.

8. Client Responsibilities

  • Clients are responsible for arriving on time and prepared for the session.

  • The client must communicate any special requests or required shots in advance.

  • The client is responsible for obtaining any necessary permissions or permits at chosen locations.

9. Privacy Policy

Client information will remain confidential and will not be shared or sold.
Images will only be used publicly as outlined in the model release section.

10. Governing Law

This agreement is governed by and construed in accordance with the laws of the Netherlands. Any disputes arising under or in connection with this agreement shall be subject to the exclusive jurisdiction of the competent courts in The Hague, the Netherlands.

By booking services with M&B Visuals, you agree to these Terms of Service.
